The short version

You’re buying a license key that unlocks your own copy of FreshGen Link, running in your own GitHub and Vercel accounts — not ours. We never host, see, or touch your deployment. You pay Kie.ai, Vercel, and GoHighLevel directly for what you use with them; we’re not a party to those accounts. The software is provided as-is, with no warranty, and our liability to you is capped at what you paid us. You’re responsible for what you generate and how you use it.

This box is a convenience summary only — if it ever conflicts with the numbered sections below, the numbered sections control.

1. Who we are and acceptance of these terms

FreshGen Link (the “Software”) is offered by Larry Scott d/b/a FreshGen (“FreshGen,” “we,” “us,” or “our”). These Terms of Service (these “Terms”) are a binding agreement between us and the person or company that purchases, downloads, deploys, or uses the Software (“you” or “your”).

By purchasing, downloading, deploying, or using the Software, you agree to these Terms. If you don’t agree, don’t purchase, download, deploy, or use it.

If you’re accepting these Terms on behalf of a company or other organization, you confirm you have the authority to bind that organization, and “you” refers to that organization.

2. What FreshGen Link is

FreshGen Link is a self-hosted MCP (Model Context Protocol) server — a small web application — that lets GoHighLevel (“GHL”) AI agents generate images and video through Kie.ai.

FreshGen Link is self-hosted. You operate your own copy. When you deploy it, the code is copied into your own GitHub account and deployed to your own Vercel account (your “Deployment”). You supply your own Kie.ai API key, your own GHL Private Integration Token (optional), and your own secret. We do not host, operate, access, administer, or have visibility into your Deployment.

We may separately offer optional paid services in addition to the one-time purchase — for example, a done-for-you installation delivered over a screen-share, or a white-label variant. If you purchase one of those, it’s covered by these Terms plus any additional details we give you at the time of that purchase.

3. License

Subject to these Terms and payment of the applicable fee, we grant you a limited, non-exclusive, non-transferable license to run and modify the Software for your own business — including operating it for your own clients and white-labeling it under your own brand — for as long as your license key stays valid.

One license key covers one Deployment. The underlying source code is published on GitHub under a source-available license — not open source. It’s published so you can read, audit, and self-host it; it isn’t free to copy or redistribute. The license file published with the source governs where it and these Terms differ, and includes these restrictions:

  • You may not remove, disable, bypass, or otherwise circumvent the license verification built into the Software, or distribute a version with it removed or disabled.
  • You may not redistribute, resell, sublicense, or publish the source code, in whole or in substantial part, with or without modification.
  • You may not share your license key, or use one license key across more deployments than you’ve purchased.

We own the Software, including all intellectual property rights in it. Nothing in these Terms transfers that ownership to you. You own the modifications you make to your own copy, subject to the restrictions above.

4. Your accounts and third-party services

Running FreshGen Link means creating and connecting your own accounts with other companies — currently GitHub, Vercel, Kie.ai, and GoHighLevel, plus Gumroad for your purchase. Those are your accounts, governed by their own terms and pricing, not ours. We’re not a party to your agreements with them, we don’t control their prices or policies, and we don’t guarantee they’ll keep working the same way — or at all — in the future.

You’re responsible for keeping your own API keys, tokens, and secrets secure, and for anything that happens under your accounts.

One note on Vercel specifically: Vercel’s free “Hobby” plan is restricted to non-commercial use under Vercel’s own terms. If you’re running your Deployment for a client or as part of a paid service, that’s commercial use, and you’re responsible for using a Vercel plan that permits it. We don’t control Vercel’s pricing or terms and take no responsibility for your compliance with them.

5. Fees, payment, and refunds

The Software is sold through Gumroad as a one-time purchase that issues you a license key. Gumroad processes your payment; we never receive or store your card or bank details.

Refunds are handled per the refund policy shown on the Gumroad checkout page at the time of your purchase. If you receive a refund, or a chargeback or payment dispute is filed, your license key is automatically deactivated — the Software checks Gumroad’s license API and stops generating images or video once that happens. We may also disable a license key ourselves for the abuse described in Section 6.

Fees you pay to third parties for actually using your Deployment — Kie.ai generation costs, Vercel hosting, GoHighLevel fees, and the like — are separate from what you pay us, are billed to you directly by those companies, and are not refundable by us under any circumstances.

6. Acceptable use

You agree to use the Software lawfully, and not to:

  • Generate, request, or distribute content that’s illegal, that depicts or sexualizes minors, or that infringes someone else’s intellectual property or other rights.
  • Use the Software to harass, defame, deceive, or impersonate any person or business.
  • Violate the terms of service or acceptable-use policies of Kie.ai, GoHighLevel, Vercel, or Gumroad.
  • Reverse-engineer, decompile, or otherwise try to defeat the license verification mechanism described in Section 3.
  • Share your license key with anyone, or use it to run more deployments than you’ve purchased.

We may disable a license key we reasonably believe is being used in violation of this section.

7. AI-generated content

The Software generates images and video using third-party AI models accessed through Kie.ai. As between you and us, you are responsible for your prompts and for the content you generate, to the extent the law allows AI-generated content to be owned at all.

We don’t guarantee that generated content will be accurate, original, or free of third-party rights. AI models can produce unpredictable, incorrect, or infringing results, and Kie.ai or the underlying model provider may block, filter, or refuse a request at their own discretion. You must have the rights to any reference images, likenesses, or other material you submit as a prompt or reference. Before using generated content commercially — in an ad, on a product, or anywhere public — check that you have the rights you need under applicable law, including intellectual property, publicity and likeness, advertising, and consumer-protection law.

8. Your responsibilities as operator

Because you operate your own Deployment, you’re responsible for it, including:

  • Keeping your Deployment’s secret URL private. Anyone who has it can generate content on your Kie.ai account.
  • Your own data handling, and any obligations you have to your own clients or customers about their data.
  • Backing up anything you want to keep. Kie.ai’s generated-media URLs expire after about 14 days — download what you want to keep, or connect a GHL Private Integration Token so finished generations auto-save to your GHL Media Library.

9. Support and updates

We offer reasonable email support for buyers, at iamjustfresh@gmail.com. We don’t guarantee a specific response time, and we don’t guarantee that any particular issue will be fixed.

We may release updates to the Software at our discretion; we’re under no obligation to do so. We may also change or discontinue features. Because the Software depends on Kie.ai, GoHighLevel, Vercel, and Gumroad, changes those companies make to their own APIs, pricing, or policies can affect how the Software works, and we’re under no obligation to maintain compatibility with changes they make.

12. Indemnification

You agree to indemnify, defend, and hold us harmless from any claim, liability, damages, loss, and expense (including reasonable legal fees) arising out of or related to: (a) your use of the Software; (b) content you generate, submit, or distribute; (c) your Deployment; or (d) your violation of these Terms, of applicable law, or of a third party’s terms of service.

13. Termination

Your license ends automatically if you materially breach these Terms, including the license restrictions in Section 3. If your purchase is refunded or successfully disputed, your license key deactivates automatically as described in Section 5. We may also deactivate your license key for the abuse described in Section 6.

Once your license ends, you must stop using the Software and delete your Deployment. Sections that by their nature should survive termination — including Sections 5 (as to amounts already owed), 7, 10, 11, 12, 14, and 16 — will survive.

14. Governing law and disputes

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Any dispute that can’t be resolved informally will be brought in the state or federal courts located in the State of Florida, and you consent to that venue.

Before filing a claim, please email us at iamjustfresh@gmail.com and give us a chance to resolve the issue informally — most things can be sorted out without a lawyer. Unless a court decides otherwise, each side pays its own legal fees.

15. Changes to these terms

We may update these Terms from time to time. We’ll post the updated version on our site with a new “Last updated” date. If you keep using the Software after an update, that means you accept the changes. If an update is material, we’ll try to give you reasonable notice, such as an email to the address on your purchase.

16. Miscellaneous

Entire agreement. These Terms, together with the license file referenced in Section 3 and any order details from your Gumroad purchase, are the entire agreement between us about the Software, and replace any earlier discussions or agreements about it.

Severability. If any part of these Terms is found unenforceable, the rest stays in effect.

No waiver. If we don’t enforce a provision of these Terms, that’s not a waiver of our right to enforce it later.

Assignment. You may not assign or transfer these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.

Trademarks. GoHighLevel and HighLevel are trademarks of HighLevel Inc. FreshGen Link is an independent product and is not affiliated with, endorsed by, or sponsored by HighLevel. Kie.ai and Vercel are trademarks of their respective owners. References to GoHighLevel in the Software and its documentation are for identification and compatibility only.
